Séance 10 - Droit de la responsabilité
Le cours des étudiants HEC est déplacé au mercredi 21 avril de 13h30 à 15h00 en salle 131.
Les étudiants ne pouvant s'y rendre pourront assister au cours du vendredi 23 avril ayant lieu de 10h30 à 12h00 en salle 132.
Pour la dernière séance, envisagez tous les documents de la fiche et commentez sous la forme de plan détaillé l'arrêt rendu par la deuxième chambre civile de la Cour de cassation le 5 octobre 2006, reproduit ci-après (commentaire d'arrêt de révision).
Civ. 2ème, 5 octobre 2006
Attendu, selon l'arrêt attaqué, que M. Y..., qui évoluait au poste de talonneur de l'équipe de rugby de l'Association jeunesse sportive illibérienne, lors d'une rencontre opposant son équipe à celle de l'Association sportive fleurantine, a été blessé dans une mêlée fermée ordonnée par Mme Z..., arbitre de la rencontre; que M. Y..., devenu tétraplégique à la suite de cet accident provoqué par le relèvement de la mêlée, sa mère, Mme A..., ainsi que sa compagne Mme B..., agissant tant en son nom personnel qu'en qualité de représentante légale de leur enfant mineur Quentin Y... (les consorts Y...), ont assigné l'Association sportive fleurantine, Mme Z... et la Fédération française de rugby en responsabilité et indemnisation devant le tribunal de grande instance ;

Sur le premier moyen :
Attendu que l'Association sportive fleurantine fait grief à l'arrêt de l'avoir déclarée responsable de plein droit des conséquences dommageables de l'accident subi par M. Y..., alors, selon le moyen, que l'association sportive n'engage sa responsabilité de plein droit qu'en cas de violation grave des règles du jeu par un joueur à l'égard d'un autre, constitutive d'un comportement déloyal ; qu'en s'étant fondée sur le fait pour la première ligne de l'équipe de Fleurance d'avoir "relevé "la mêlée, la cour d'appel a violé l'article 1384, alinéa 1er, du code civil ;
Mais attendu que l'arrêt retient que le refus de la poussée adverse constituait une faute, le "relevage" étant dangereux pour l'adversaire prisonnier entre une ligne d'avants qui ne reculait plus et une poussée de sa propre équipe dont il supportait toute la puissance, qui ne s'exerçait plus sur les adversaires ; que la faute des joueurs de Fleurance ayant systématiquement relevé la mêlée était établie, et était imputable collectivement aux joueurs de l'équipe qui ne pouvaient ignorer la stratégie d'ensemble mise en oeuvre par les avants et visant à refuser la poussée adverse; qu'il s'agit là d'une violation de la lettre et de l'esprit du rugby ;
Qu'en l'état de ces constatations et énonciations, dont il résulte que les joueurs de l'Association sportive fleurantine avaient délibérément relevé la mêlée au cours de laquelle M. Y... a été blessé, la cour d'appel a pu décider qu'ils avaient commis une faute caractérisée par une violation des règles du jeu, qui engageait la responsabilité de l'association ;
D'où il suit que le moyen n'est pas fondé ;
Mais sur le deuxième moyen :
Vu l'article 1384, alinéa 5, du code civil ;
Attendu que n'engage pas sa responsabilité à l'égard des tiers le préposé qui agit sans excéder les limites de la mission qui lui a été impartie par son commettant ;
Attendu que, pour déclarer Mme Z... personnellement responsable des conséquences dommageables de l'accident subi par M. Y..., l'arrêt énonce que la faute de l'arbitre a consisté à ne pas pénaliser le "relevage" des mêlées, ce qui a eu pour effet de décourager dès la première mi-temps la stratégie de Fleurance et de faire cesser la poussée dont avait été victime M. Y..., loyale de la part de ses équipiers mais dommageable en ce qu'elle était confrontée aux avants adverses relevés ; que le coup de sifflet de l'arbitre aurait eu pour effet de faire cesser la contrainte subie par les cervicales de M. Y... ;
Qu'en se déterminant ainsi, alors qu'il résultait de ses constatations que Mme Z... avait agi dans les limites de sa mission, la cour d'appel a violé le texte susvisé ;

Vu l'article 627 du nouveau code de procédure civile ;
PAR CES MOTIFS :
CASSE ET ANNULE, mais seulement en ses dispositions ayant déclaré Mme Z... personnellement responsable des conséquences dommageables de l'accident subi par M. Y..., et alloué une provision à valoir sur l'indemnisation de l'enfant mineur Quentin Y..., l'arrêt rendu le 25 mai 2005, entre les parties, par la cour d'appel de Montpellier ;
DIT n'y avoir lieu à renvoi ;
